Acts of the law
What are the sources of law in Poland?
Sources of law include two categories: sources of universal law and domestic laws.
- The sources of universal law are:
- Constitution of the Republic of Poland of April 2, 1997-The most important legislative act in Poland,
- ratified international agreements,
- laws-basic acts of universal law,
- resolutions-acts issued by the bodies specified in the Constitution (i.e., the President, Prime Minister, Council of Ministers, Ministers and National Broadcasting Council) on the basis of detailed authorization contained in the law and for its implementation,
- acts of local legislation-acts that are valid only in the sphere of activity of the bodies that issued it; and within the limits of the powers contained in the laws.
- Acts of internal law, for example, a resolution of the Council of Ministers, a Presidential decree – acts of an internal nature, are exclusively related to persons subordinate to the body issuing this act.
Where can I find current acts of Polish legislation?
Acts of generally accepted law are announced in official publications: in the Journal of Laws of Poland, in the Official Journal of Poland-Polish Monitor, in the official journals of ministers, in the official journals of central departments and in voivodeship official journals. The Journal of Laws and the Polish Monitor have been published electronically since 2012.
The most reliable place is the Internet System of Legal acts (ISAP): isap.sejm.gov.pl, available from the Seimas website. The ISAP database contains regularly updated texts of legislative acts published in the Journal of Laws of the Republic of Poland or the Official Journal of the Republic of Poland (Polish Monitor). Legal acts are published together with bibliographic descriptions, and the ISAP database does not contain texts of local or domestic legal acts.
Legal acts – both published and unified texts-are published in the ISAP database as PDF files. Electronic versions of legal acts available in the ISAP database are for INFORMATIONAL purposes only and are not sources of law.
